lee county justice court judge responds to the commissioner of the department of public safety's statement in regards to the recent dismissal of a dui case against tupelo city attorney ben logan..... judge chuck hopkins told wtva we're going to handle our business in court and do that by following the law. his statement comes on the heels of what commissioner marshall fisher. ben logan went to court on july 11th of this month to face a judge for the dui refusal charge... his defense attorney filed a motion claiming the road block did not give warning signs leading up to the checkpoint.... they also challenged who set up the roadblock and where it was placed.... now... commissioner marshall fisher of the mississippi department of public safety which oversees the mississippi highway patrol said judge hopkins "had neither the law nor the facts on his side" when he dismissed the case.... fisher in this statement went on to say that troopers followed the law when they noticed a vehicle, driven by logan, attempted to avoid the checkpoint by pulling into a private drive of a closed business. the commissioner went on to say the troopers followed the law while the non-attorney justice court judge "ignored it and then created his own requirements for a safety
