an ongoing murder investigation that continues to have new developments. a judge has now recused himself in the murder trial of this former oxford police officer, 38 year old matthew kinne. circuit court judge andrew howorth signed the order this afternoon. kinne has been charged with murder for the death of this woman, 32 year old dominique clayton of oxford. this after clayton was found dead at her home on suncrest drive. wtva's amanda haley is in oxford and joins us live with why the judge stepped aside and what impact it could have on the case. the order of recusal wasn't the only order signed today by judge andrew howorth. he also ordered the file of matthew kinne sealed from public view. this afternoon, judge howorth signed an order to move away from the case in order to help it move forward. howorth says he was approached by a victims right coordinator who says the family of dominique clayton wanted him to be off the case. the move comes one day after matthew kinne was ordered help without in jail until a bond hearing would be held next week. it was a move her family was not happy with. sot - bessie clayton, mother of victim "this judge has to go. hes gonna let the defendent choose his own bond?"howorth stated in his order the comments made by the family were reported by media. he says he understands them being upset because they are victims of the death of their daughter as well. he says some of those statements were made in anger and grief. howorth says he is stepping aside to protect the fairness of the case moving forward. howorth also signed an order to seal the court file on kinne. the move will limit access to court personnel and lawyers in the case. the file was removed from an online portal use by the public to view cases. lafayette county circuit court clerk baretta mosley says howorth notified the other two judges in the district of his decision. at this time, no judge has been named to take over the case. in oxford, i'm amanda haley, for wtva 9 news "he really took this child from her mother. her mother did not birth her in this world for her to get dogged out like this the way it happened." and as you can imagine, emotions still remain high following yesterday's hearing. family members of clayton made it clear how hurt they are after they left the courtroom yesterday. community memebrs said they are shocked to hear what the former police officer is accused of doing. kinne remains at the panola county jail until his next court appearance. at , matt's
