STARKVILLE, Miss. (WTVA) - An Oktibbeha County man has again lost an attempt to have a life sentence for capital rape overturned on appeal.
John Henry Lofton, 62, appealed a 1993 conviction to capital rape along with charges of kidnapping and aggravated assault.
The victim in the case was under the age of 14.
He was sentenced to life plus 20 years in prison and prosecutors agreed to retire two other capital rape charges to the file.
In 2015, he asked the Mississippi Court of Appeals to rule the trial judge did not have the authority to impose a life sentence.
The appeals panel upheld the conviction in June stating the judge followed state law.
They denied his request to rehear the case on Tuesday, December 12.
