Changes made to Tupelo's executive order

Tupelo city council made changes to the city's executive order after Gov. Reeves issued his new guidelines for slowing the spread of coronavirus.

TUPELO, Miss. (WTVA) - Tupelo Mayor Jason Shelton took to Facebook Wednesday night to explain the changes made to the city's executive order in regards to stopping the spread of the coronavirus. 

Some of the changes include restaurant dine-in service. The city suspended dine-in services on Sunday, March 22.

However, Wednesday that changed after Gov. Tate Reeves issued his executive order on Tuesday. 

According to the updated order, "restaurants, bars, or other dining establishments to offer dine-in services unless unable to reduce capacity to allow no more than 10 people to be gathered in a single space at the same time where individuals are in seated or otherwise in close proximity."

Shelton explained why the change was made on his Facebook page. 

Most of Tupelo's COVID-19 orders and the provisions therein will remain, but the Governor explicitly ordered that any local government's rules that will or might in any way conflict with or impede the purpose of this Executive Order is suspended and unenforceable during this Covid-19 State of Emergency." That means that where there is a difference, the Governor's Order prevails. Therefore the city's mandate of all adhering to President Trump's 15 day plan, mandating compliance with CDC and MSDH COVID-19 recommendations in all workplaces, and Tupelo's safety protections pertaining to restaurants will be superseded by the Governor's Executive Order. The city has no discretion in this - the Governor's Executive Order supersedes as a matter of law. The Governor's Executive Order can only be overturned by the Mississippi legislature or the court system.

I strongly recommend that everyone follow the CDC and MSDH guidelines and the recommendations of our own North Mississippi Medical Center. The only way to slow this down is to be proactive and do our part to flatten the curve.

Also, auto sales have been added to essential services.

The executive order is in effect until April 17, 2020.
