Settlement reached over church location

HOLLY SPRINGS, Miss. (WTVA) -- A legal battle over a ban on churches locating on the town square in Holly Springs is over.

On Thursday, attornies for Opulent Life Church announced a settlement had been reached in a lawsuit filed over the city ordinance denying churches permission to locate on the square.

In January 2012, the church filed a federal court lawsuit against the city claiming the measure unfairly singled-out churches and asked for an injunction over its enforcement.

A federal judge denied the request, but the U. S. Fifth District Court of Appeals overturned the ruling.

The three-judge panel ruled the city's ordinance violated Equal Terms Clause of the Religious Land Use and Institutionalized Persons Act.

A federal judge issued the restraining order and injunction in October.
