JACKSON, Miss. (WTVA) -- The Mississippi Supreme Court has thrown out the conviction in a Lafayette County burglary case.
On Thursday, the state's highest court ordered a new trial for Edward Daniels, 33.
Daniels was convicted in October of 2010 following a trial in Lafayette County Circuit Court.
Daniels was not present for trial and was later sentenced to life in prison.
He appealed claiming one of the jury instructions didn't include the mention of a crime and therefore was faulty.
In their ruling, the Mississippi Supreme Court agreed and sent it back for a new trial.
