Man loses appeal of sentence in drug case

JACKSON, Miss. (WTVA) -- A Columbus man has lost his attempt to have his guilty plea and sentence in a drug case overturned.

Shawn Lamont Doss, 35, pleaded guilty to possession of more that five kilograms of marijuana in November of 2008.

The state agreed to a 20 year sentence, but when Doss failed to show up at his sentencing hearing, the judge handed down an enhanced sentence of 50 years in prison because Doss had prior drug convictions.

Doss appealed claiming the judge should have held with the state's recommendations or allowed him to withdraw the guilty plea when the judge didn't follow the recommendation.

He also contends the court was wrong to allow the indictment to be amended to list him as a previous offender without notifying him.

On Tuesday, the Mississippi Court of Appeals denied the claims.
