JACKSON, Miss. (WTVA) -- A Columbus man has lost his attempt to have a portion of the sentence given him reduced.
Johnny Lewis Washington, 58, is serving life in prison plus 60 years for capital murder, armed robbery, and aggravated assault.
Washington was indicted for his role in the armed robbery of Wood's Quick Pick convenience store in Columbus on March 26, 1977.
Authorities say during the robbery, Washington shot and killed the store's owner, J. K. Woods.
He was convicted of capital murder following a trial and sentenced to death.
Washington's sentence was later commuted to life in prison.
He was later indicted and pleaded guilty to armed robbery and aggravated assault in connection with the holdup.
He was sentenced to serve a 60 year sentence following the completion of his life sentence.
Washington appealed the sentence on the aggravated assault charge after a judge refused to grant a motion for post conviction relief filed in 2011.
The Mississippi Court of Appeals on Tuesday denied his request saying the filing was outside the time frame allowed.
The court also ruled the trial judge was correct to dismiss the motion because Washington had not followed the proper remedies set forth in law, which was to contest them with the Mississippi Department of Corrections.
