JACKSON, Miss. (WTVA) -- A Winston County man has lost his attempt to have his life sentence overturned by the Mississippi Court of Appeals.
James Allen Higginbotham, 40, is serving a life sentence after pleading guilty to murder in the shooting death of L. S. Vowell, 71, of McCool.
Higginbotham was among four people arrested in the death of Vowell on December 9, 2007.
In his appeal, Higginbotham claims in his appeal he should have been sentenced to life with a possibility for parole after 10 years instead of a life sentence without the possibility of parole.
He also claims he would not have entered a guilty plea had his attorney not told him he would be eligible for parole in 10 years.
The Mississippi Court of Appeals upheld the conviction and verdict Tuesday.
