Union County man appeals drug conviction

OXFORD, Miss. (WTVA) -- A Union County is asking a federal judge to have his conviction and sentence on drug charges thrown out on appeal.

Carlos Ivy, 30, is serving a 15-year sentence for possession of cocaine and child endangerment following a guilty plea in Union County Circuit Court in 2010.

He was also ordered to serve five years probation after his release.

Ivy says the jail time and probation when combined is longer than the maxiumum sentenced allowed under state law.

He also claims he was the subject of an illegal search and seizure and his guilty plea was involuntary.

The Mississippi Court of Appeals upheld the sentence and the Mississippi Supreme Court dismissed a request to review the case.

The appeal was filed in U. S. District Court on Monday.
