Man loses appeal in fondling, sexual battery case

JACKSON, Miss. (WTVA) -- A Tishomingo County man has lost his attempt to have his conviction and sentence in a fondling and sexual battery case thrown out.

Milford Ivey, 70, is serving 15 years in prison after pleading guilty to two counts of fondling and one count of sexual battery.

Ivey was indicted for the sexual assault of a minor in May and June of 2006 and pleaded guilty during a court hearing in 2009.

In his appeals, he claimed he entered the plea under duress, his was the victim of double-jeopardy and the sentence violated state law because it exceeded his life expectancy.

The Mississippi Court of Appeals denied his claims on Tuesday.
