Court upholds revocation in Tishomingo County case

IUKA, Miss. (WTVA) -- A Tishomingo County man has lost his attempt to be released from prison.

Tracy Handy, 43, was appealing a judge's order sending him back to prison for violation of probation.

Handy had served a five year sentence for fondling and was serving five years probation when he was arrested on a domestic violence charge.

Prosecutors asked the court to revoke his bond and return him to prison.

Handy claims the court denied his due process rights.

On Tuesday, the Mississippi Court of Appeals denied the appeal.

In their ruling, they say prosecutors provided evidence Handy pleaded guilty to the domestic violence charge in justice court and there is not merit to his claim the court erred in revoking his suspended sentence.
