Appellate court denies rehearing in capital murder case

JACKSON, Miss. (WTVA) -- The Mississippi Supreme Court has denied a request to rehear its decision to uphold the conviction and death sentence handed down in an Oktibbeha County case.

Bobby Batiste, 33, is on death row for the 2008 robbery and beating death of Andreas Galanis, 28, of Biloxi.

The men were roommates at an apartment complex in Starkville while students at Mississippi State.

Among the 15 complaints Batiste filed in an attempt to have the case overturned, he claims the judge never allowed the jury to hear his side of the case.
His attorney says evidence of the theft of Galanis's wallet occured so long after the man's death it shouldn't have been used to support the capital murder conviction.

Justices upheld his conviction in May.
