Court denies review of home invasion case

JACKSON, Miss. (WTVA) -- The Mississippi Supreme Court has denied a request to review the conviction in a Monroe County home invasion.

John Daniel Rodgers, 21, was found guilty during a trial in February 2010 of armed robbery, burglary of an occupied dwelling, and conspiracy.

Rodgers and three other men were arrested in the October 2008 robbery and beating of Doyle and Virginia Harris at the couple's home on Highland Circle in Amory.

He was sentenced to 15 years in prison. 

In his appeal, Rodgers' attorney says he suffered a brain injury at birth, suffered from a form of autism, and suffered "diminished capacity".

In their filing, they claimed the trial judge was wrong not to allow an expert witness to testify on Rodgers behalf.

The Mississippi Court of Appeals has previously upheld his conviction.
