Judge throws out plea for depraved heart murder

FULTON, Miss. (WTVA) -- An Itawamba County Circuit Court judge has ordered a new trial for a man serving a life sentence in the death of his four-month-old daughter.

Joshua Clark, 31, of Nettleton was charged with capital murder in 2008 in the death of Kylie Clark.

The girl died at Lebonheur Children's Medical Center in Memphis and investigators say injuries the child suffered and other evidence caused them to believe the abuse had occured over time.

Kylie's twin brother was also hospitalized because of the same incident.

Clark pleaded guilty to charges of depraved heart murder and child abuse and was sentenced to life plus 20 years.

Last week, a judge signed the order for a new trial.

Clark will be held on the original charged of capital murder until his case comes to court.
