WEST POINT, Miss. (WTVA) -- A federal judge has denied a request by five people to have the Democratic primary races in West Point declared null and void.

The ruling was issued after a hearing in U. S. District Court in Oxford Monday morning.

The group includes Jasper Pittman, the incumbent alderman in Ward 5, who missed the runoff in his ward by one vote.

The five claimed the city conducted the election at the request of the Democratic Party chairman for the city of West Point.

The motion claimed the city violated their rights by overseeing the election because there is no Democratic executive committee in the city.

The claim the city did not have the authority to conduct the election and the chairman didn't have the authority to ask the city to oversee it.

Polls open at 7 a.m. Tuesday.
