Lawsuit over West Point primary election dismissed

WEST POINT, Miss. (WTVA) --  A federal lawsuit filed by five people over the Democratic primary races in West Point has been dismissed.

A federal court judge signed the order to dismiss the lawsuit on Friday.

The group, including Jasper Pittman who lost his reelection bid in Ward 5 by one vote, claimed the city conducted the election at the request of the Democratic Party chairman for the city of West Point.

The lawsuit claimed the city violated their rights by overseeing the primary election because there is no Democratic executive committed in the city.

The case was voluntarily dismissed with prejudice, which means it can now be refiled.
