Court will not review appeal in sexual battery case

NEW ORLEANS, Miss. (WTVA) -- A Clay County man has lost his attempt to have a federal appeals court review his conviction on sexual battery charges.

The Fifth District Court of Appeals in New Orleans issued the decision late last week in the appeal of James Earl Holmes, 55.

Holmes is serving 30 years in the South Mississippi Correctional Institution in Leakesville.

He was convicted following a jury trial in 2007 and sentenced as a habitual offender.

In his appeals, Holmes claimed ineffective counsel and the fact evidence didn't support the verdict handed down by a jury.

State appeals court denied the claims, which have also been dismissed by a U. S. District Judge.
