Court denies appeal of Clay County man

NEW ORLEANS (WTVA) -- The U. S. Fifth Circuit Court of Appeals has rejected the appeal of a Clay County man serving a life sentence on drug charges.

Eli "Tom" Orr, 59, of Una was convicted by a federal jury in June of 2003 on one count of conspiracy to distribute crack cocaine and two counts of distributing crack cocaine.

His arrest came after an investigation by the North Mississippi Narcotics Unit, the Mississippi Bureau of Narcotics, the Highway Patrol and the U. S. Drug Enforcement Agency.

Because he had five previous convictions in Mississippi and Illinois, a federal judge ordered him to serve three life sentences.

Orr has filed previous motions to have the judgement vacated or reduced, but each has been denied.

The latest appeal was rejected because it was filed outside of the deadline to file an appeal.
