JACKSON, Miss. (WTVA) -- A Choctaw man serving life in prison for DUI will not have his case reviewed by the Mississippi Supreme Court.
On Thursday, the Mississippi Supreme Court denied the appeal of Ottis Cummings, 56.
Cummings pleaded guilty to charges of burglary and aggravated assault in 1979 and had served both sentences according to court records.
In 2009, he was convicted of felony DUI and was sentenced under the state's habitual offender status to life in prison without the possibility of parole.
Cummings appeals over the language in the indictment, an illegal sentence, ineffective counsel and sentencing him as a habitual offender were denied by the Mississippi Court of Appeals last July.
