Appeal denied in Choctaw County statutory rape case

JACKSON, Miss. (WTVA) -- The Mississippi Court of Appeals have denied a request to overturn the statutory rape conviction and sentence handed down in Choctaw County.

Elroy Kennedy, 36, is serving 25 years in prison after pleading guilty to having inappropriate contact with a minor under the age of 14.

Court papers says Kennedy appealed saying his indictment was defective and he didn't get good legal counsel before entering a guilty plea.

In their ruling, the appellate judges say Kennedy waived certain rights of appeal when he pleaded guilty to the charge.

They say he also failed to show how his lawyer's performance was deficient.
