Appeals court brings back lawsuit over wreck involving police

The Mississippi Court of Appeals has reinstated a lawsuit filed over a traffic accident involving a police officer in Tupelo.

JACKSON, Miss. (WTVA) - The Mississippi Court of Appeals has reinstated a lawsuit filed over a traffic accident involving a police officer in Tupelo.

The lawsuit claims Keith Bowdry was on duty in 2011 when he pulled out of a South Gloster Street convenience store and collided with another vehicle.

Bowdry was treated at the hospital for neck and back injuries.

He sued T-Mart and Tommy Brooks Oil Company claiming shrubbery on the property of the convenience store blocked his line of sight and contributed to the crash.

A trial judge dismissed the lawsuit after the companies provided records showing Bowdry had suffered prior injuries in another accident in 2005.

The Mississippi Court of Appeals says while the medical records showed the previous injuries, Bowdry had done nothing in the discovery portion of the trial to warrant a judge to dismiss the case.

The case returns to Lee County Circuit Court.
